Rules of public procurement

The rules of the State Customs Committee of the Republic of Uzbekistan on behavior while public procurement (further - Rules) is developed in accordance with Article 38 of the Law of the Republic of Uzbekistan "On Public Procurement".

The customs officials of the State Customs Service shall observe these Rules during the procurement of goods (works, services).

1. During the public procurement process, the following principles shall be applied:

customer's professional skills;

reliability and transparency;

impartiality and proportion;

follow the uniform public procurement system;

efficient and rational use of financial resources;

avoid corruption.

2. Employee and procurement committee members responsible for the procurement process should respond to professional requirements.

3. In order to avoid a conflict of interest in public procurement, attention is paid to the following:

public procurement employees and members of the commission may not make the choice in the procurement procedures due to their own interest;

public procurement employees and members of the commission should promptly disclose and report directly to the management of any potential, predictable or current conflict of interest;

the management which has received information on the existence of a conflict of interests, should take immediate action to prevent or eliminate it.

4. During the public procurement process, the following should not be allowed:

discrimination of participants of public procurement, giving preferences to participants that causes discrimination to the other participants;

unlawful selection of public procurement methods and influence on participants;

disclosure of information about participation, unreasonable restrictions on their number and increase of qualification requirements (except for cases specified by the legislation);

Changing the prices and the results of the selection of participants, or the display of false information;

the introduction of not connected goods (works, services) in the structure of public procurement, both technically and functionally.

5. In case of violation of the rules by the employees, they shall be liable in accordance with the procedure established by the legislation.
